The Constitution and Almighty God state that all people have the right to life, liberty, and the pursuit of happiness (maybe God wouldn’t say we have the right to happiness, but He does say we can choose how we live)
We should absolutely have free speech.
But we often say we don’t have the right to yell “fire” in a crowded theater (when there is no fire)
That’s true. But why?
The reason we cannot do that is because that speech only serves to cause panic & chaos — and it provides nothing to actual discourse except harm and the very thing that law intends to prevent.
This, of course, can be abused. And a version of this is what we’re seeing social media companies do to censor and silent conservatives. So context is absolutely king. But context matters.
The Schenck case:
The most stringent protection of free speech would not protect a man falsely shouting fire in a theatre and causing a panic... The question in every case is whether the words used are used in such circumstances and are of such a nature as to create a clear and present danger that they will bring about the substantive evils that Congress has a right to prevent.
